Requirement to Notify Court of Any Request for Evidentiary Hearings

Print Guideline

In any criminal motion in which a party believes an evidentiary hearing is necessary, the party shall include within the motion and/or response a written request for an evidentiary hearing stating the reasons therefor and, no later than one week before the hearing, shall submit to the Court a witness list identifying each witness that party intends to call at the evidentiary hearing, along with each witness's anticipated length of testimony. And, to the extent any proposed exhibit has not been attached to the pleadings, the party shall also submit a list of any proposed exhibits. These documents should be emailed to: efile_berg@mied.uscourts.gov.
